1. Scope

These Terms and Conditions apply to all orders placed through the online shop available at www.amaraan.com and to all contracts concluded between UAB Daisena and its customers through this website.

By placing an order on our website, the customer accepts these Terms and Conditions.

These Terms and Conditions apply to consumers and, where applicable, business customers, unless expressly stated otherwise.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

A business customer is any natural or legal person, or partnership with legal capacity, who acts in the exercise of their trade, business or profession when entering into a legal transaction.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to the customer to submit a binding order.

The customer can select products and place them in the shopping cart. Before submitting the order, the customer can review and correct the information entered at any time.

By clicking the final order button, such as “Buy now”, “Pay now”, “Complete order” or a similar button, the customer submits a binding offer to purchase the goods contained in the shopping cart.

After receipt of the order, the customer will receive an automatic order confirmation by email. This email confirms that the order has been received, but does not necessarily constitute acceptance of the order.

The purchase contract is concluded when we accept the order by sending a separate order confirmation, dispatch confirmation, or by shipping the ordered goods.

We reserve the right to reject orders for legitimate reasons, including but not limited to product unavailability, pricing errors, suspected fraud, payment issues, or delivery restrictions. If payment has already been made, the amount will be refunded without undue delay.


4. Customer Account and Order Process

Customers may place orders as guests or, where available, through a customer account.

When creating a customer account, the customer must provide accurate, complete and up-to-date information.

The customer is responsible for keeping login details confidential and for preventing unauthorised access to the customer account.

Order processing and communication generally take place by email. The customer must ensure that the email address provided is correct and that emails from us can be received.


5. Prices, VAT and Shipping Costs

All prices shown in the online shop are final prices and include the applicable value added tax, unless expressly stated otherwise.

Any additional shipping costs will be displayed separately during the order process before the customer submits the order.

The total price, including applicable VAT and shipping costs, will be displayed before completion of the order.

We reserve the right to correct obvious pricing errors. If a product was listed with an incorrect price, we may cancel the order and refund any payment already received.


6. Payment Terms

The available payment methods are displayed during checkout.

Payment is due immediately upon conclusion of the contract, unless another payment term is expressly agreed.

Where payment is processed through third-party payment providers, the terms and conditions of the respective payment provider may also apply.

We reserve the right to refuse certain payment methods depending on the order value, destination country, risk assessment or payment provider availability.


7. Delivery and Shipping

Delivery is made to the shipping address provided by the customer during checkout.

The estimated delivery times displayed on the website or during checkout are non-binding unless expressly agreed otherwise.

If delivery to the customer fails due to incorrect, incomplete or inaccessible delivery information provided by the customer, the customer may be responsible for any additional shipping costs incurred.

If goods are returned to us because delivery could not be completed, we may refund the purchase price after deducting any costs legally permitted, unless the customer is not responsible for the failed delivery.

In the event of delays caused by carriers, customs, strikes, force majeure, public holidays or other circumstances outside our control, delivery times may be extended.


8. Right of Withdrawal

Consumers generally have a statutory right of withdrawal in accordance with applicable consumer protection laws.

The right of withdrawal may be excluded or limited in certain legally permitted cases, for example for sealed goods that are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery.


9. Returns and Refunds

Returns must be made in accordance with our Return Policy and any instructions provided by our customer service team.

Refunds will generally be made using the same payment method used for the original transaction, unless expressly agreed otherwise.

We may refuse a refund until we have received the returned goods or until the customer has provided proof of return shipment, whichever occurs first.

The customer may be responsible for return shipping costs unless otherwise required by law or agreed by us.


10. Retention of Title

The goods remain the property of UAB Daisena until full payment has been received.


11. Statutory Defect Liability

The statutory rights relating to defective goods apply.

If the delivered goods are defective, the customer may be entitled to statutory remedies in accordance with applicable law.

Any additional commercial guarantee only applies if expressly provided for the respective product.


12. Liability

We are liable without limitation for damages caused intentionally or by gross negligence, and for damages resulting from injury to life, body or health.

In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to foreseeable, typical contractual damages.

Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.

Any further liability is excluded to the extent permitted by law.

The limitations of liability also apply to our legal representatives, employees and agents.

Liability under mandatory product liability laws remains unaffected.


13. Gift Cards and Promotional Codes

Gift cards and promotional codes can only be redeemed in accordance with the conditions stated at the time of issue.

Promotional codes may be limited in time, product range, customer group or minimum order value.

Unless expressly stated otherwise, promotional codes cannot be exchanged for cash, combined with other promotions, or applied retroactively to previous orders.


14. Intellectual Property

All content on this website, including texts, images, graphics, logos, designs and product presentations, is protected by intellectual property laws.

Any reproduction, distribution, modification or commercial use without prior written permission is prohibited.


15. Data Protection

16. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Lithuania, excluding the United Nations Convention on Contracts for the International Sale of Goods.

If the customer is a consumer residing in another country, mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected.

Where legally permitted, the place of jurisdiction shall be the competent courts of the Republic of Lithuania.


17. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution:

We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.


18. Final Provisions

If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
